Terms of Service
These terms explain how NeverSub works, what hosts and members are responsible for, and how money is handled when the product launches.
1. Our role as a platform
NeverSub is a platform that helps people who already trust each other find, join and manage rooms for sharing one subscription or bundle. We are an intermediary under the Information Technology Act, 2000 and the rules made under it.
NeverSub is not a reseller. It does not resell, sublicense, lease or provide any third-party service itself. A host is the person who says they lawfully hold the access being shared. A member is the person joining that room.
We do not promise that any third-party plan will allow sharing, stay available, stay unchanged or work on every device. Hosts and members must check and follow the rules that apply to the thing being shared.
2. Waitlist terms
Today, only the NeverSub waitlist is live. Joining the waitlist does not create a paid account, reserve a room or require a payment.
A referral code may be carried in a URL. The code identifies the referrer for waitlist rewards; it does not carry the referrer’s email address.
We may change launch timing, founding perks or early access order if the product, law or operational constraints require it. We will try to be plain about any material change.
3. Accounts, communities and eligibility
From launch, you may need an account and a verified community to create or join rooms. Colleges and companies may be verified by email domain. Residential societies and private circles may be verified by invite or another check we disclose in the product.
Give accurate information, keep your account secure and do not let another person use your account to avoid these Terms. If you are under 18, use NeverSub only with involvement of a parent or guardian where the law requires it.
We may refuse, limit or remove access where we reasonably believe a community, room or account is fake, unsafe, unlawful or being used to bypass another provider’s rules.
4. Rooms and sharing rules
A room can cover one subscription or one bundle. It may be an offer, a request or an exchange. Pricing may be fixed, a price range with bids, or an exchange agreed between the people in the room.
Hosts must describe the room honestly: what is being shared, the number of seats, the billing cycle, the price, the access method and any limits a member needs to know before paying.
Members must use access only for the room purpose, must not sell it onward, must not publish credentials, and must not use NeverSub to share anything unlawful, unsafe or not theirs to share.
5. Payments, escrow and wallets
Prices shown on this site may be converted for display. The currency you are charged in, and the payment methods available to you, are confirmed at checkout before you pay. Amounts are calculated in the smallest unit of the billing currency in our systems.
Money for a room is held in escrow for the whole billing cycle and is released to the host’s NeverSub wallet only after the cycle has run, subject to refunds, chargebacks, compliance checks and these Terms.
Funds are held through a payment partner. NeverSub is not a bank or NBFC, and is not a payment bank or deposit-taking institution. We do not pay interest on escrowed funds or wallet balances.
Version 1 has no NeverSub platform fee. Payment partner charges, taxes or later platform fees may apply only if they are shown before payment or notified as required by law.
6. Refunds, failed rooms and complaints
If a room does not start, access is not provided, or the room materially differs from what was promised, we may refund members from escrow instead of releasing funds to the host.
A short confirm-or-refund window may be used after payment to catch obvious failures. That window does not release host funds early; escrow still lasts for the billing cycle unless the room is refunded.
NeverSub is not a court and does not guarantee dispute mediation. We may ask for evidence, freeze a payout, reverse a wallet credit, suspend a room, or take another proportionate step to protect members and comply with law.
7. Consumer information
Where the Consumer Protection (E-Commerce) Rules, 2020 apply, we will provide clear information in the product about the host, room terms, price, escrow flow, refund route and grievance contact before payment.
If you believe a listing is misleading, unlawful or violates your rights, write to us at [email protected] with the room details. We will review it under our intermediary duties and applicable law.
8. Platform rules
Do not use NeverSub for fraud, harassment, unlawful sharing, scraping, spam, payment manipulation, fake referrals, impersonation or anything that harms another user or the platform.
Do not upload or send content that is unlawful, defamatory, obscene, invasive of privacy, infringing, harmful to children, or otherwise prohibited under the Information Technology Act, 2000 and applicable rules.
We may remove content, restrict features, suspend accounts, block payouts or end rooms where needed to enforce these Terms, comply with law or protect users.
9. Service limits
We will try to operate NeverSub with reasonable care. Still, the product may be interrupted, delayed, changed or unavailable, especially during launch.
To the fullest extent allowed by applicable law, we are not responsible for loss caused by third-party plan changes, payment network failures, wrong information supplied by a host or member, or events outside our reasonable control.
Nothing in these Terms limits rights that cannot be limited under applicable consumer, data protection or other mandatory law.
10. Changes to these Terms
We may update these Terms as the product moves from waitlist to launch and as law or payment flows change. The latest version will be posted here with its last updated date.
If a change materially affects paid use, escrow, wallet balances or your rights, we will give reasonable notice through the product or by email where practical.
11. Governing law and contact
These Terms are governed by the laws of India. Subject to mandatory consumer remedies available under Indian law, the courts of New Delhi will have jurisdiction.
